Jane Morgan writes Mississippi College Law Review article
Jane B. Morgan recently wrote an article for the Mississippi College Law Review entitled, "The Arbitration Exception in Third Party Legal Opinions: Dead or Alive?". The article discusses whether it is appropriate to take an exception for an arbitration provision in a third-party legal opinion on the enforceability of a commercial agreement, notwithstanding the many Mississippi Supreme Court and federal court decisions that strongly favor arbitration. The article warns that an opinion-giver in a commercial transaction should consider the holding of the United States Supreme Court in Hall Street Associates, L.L.C. v. Mattel, Inc., 128 S.Ct. 1396 (2008), before opining on the enforceability of an arbitration provision.
